As part of the use of this app, your personal data will be processed by us as the person responsible for data processing and stored for the period necessary to fulfill the specified purposes and legal obligations. According to Art. 4 No. 1 General Data Protection Regulation (GDPR), personal data is all information that relates to an identified or identifiable natural person.

With the following data protection declaration we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, as far as we decide either alone or together with others about the purposes and means of processing. In addition, we will inform you below about the third-party components we use for optimization purposes and to increase the quality of use.

Contact inquiries / contact options

 

If you contact us via the contact form or email, the data you provide will be used to process your request. The specification of the data is necessary for processing and answering your request - without providing it, we cannot answer your request, or at least only to a limited extent.

The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR.

Your data will be deleted if your request has been finally answered.

 

II. Rights of users and data subjects

 

With a view to the data processing described in more detail below, users and data subjects have the right

 

  • for confirmation as to whether the data concerning you are being processed, for information about the processed data, for further information about the data processing and for copies of the data (see also Art. 15 GDPR);

  • to correct or complete incorrect or incomplete data (see also Art. 16 GDPR);

  • to the immediate deletion of the data concerning them (cf. also Art. 17 GDPR), or, alternatively, if further processing is required in accordance with Art. 17 Para. 3 GDPR, restriction of processing in accordance with Art. 18 GDPR;

  • to receive the data concerning them and provided by them and to transfer this data to other providers / responsible parties (cf. also Art. 20 GDPR);

  • to complain to the supervisory authority, provided that they are of the opinion that the data concerning them are being processed by the provider in violation of data protection regulations (see also Art. 77 GDPR).

In addition, the provider is obliged to notify all recipients to whom data has been disclosed by the provider of any correction or deletion of data or the restriction of processing that takes place on the basis of Articles 16, 17 Paragraph 1, 18 GDPR teaching. However, this obligation does not exist if this notification is impossible or involves disproportionate effort. Irrespective of this, the user has a right to information about these recipients.

 

In accordance with Art. 21 GDPR, users and data subjects also have the right to object to the future processing of their data, provided that the data is provided by the provider in accordance with Art. 6 Para. 1 lit. f) GDPR are processed. In particular, an objection to data processing for the purpose of direct advertising is permitted.

 

III. Information on data processing

 

Your data processed when using our website will be deleted or blocked as soon as the purpose of storage no longer applies, the deletion of the data does not conflict with any statutory retention requirements and no other information on individual processing methods is given below.

 

Server data

 

Imagine uses the Google Firebase service. As a Google company, Firebase is subject to Google's privacy policy : Google Privacy Policy . The data may be stored on servers in the USA. Among other things, Google has certification for the EU-US Privacy Shield Agreement and thus guarantees that the EU's data protection requirements are also complied with when processing data in the USA.

Download the app
 

When you download the app, the information required for this is transferred to the Google Play Store if you use our app on an Android device or the Apple App Store if you use our app on an iOS device. In particular, the user name, email address and customer number of your account, the time of the download, payment information and the individual device code as well as other data are required. We have no influence on this data collection and processing and are not responsible for it. We only process the data insofar as it is necessary to download the app to your device. For technical reasons, in particular to ensure a secure and stable website, data is transmitted to us. These so-called log files are used to collect the version of your smartphone, the operating system and the app version. This data collected in this way is temporarily stored, but not together with other data from you.

This storage takes place on the legal basis of Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our website.

 

Registration with Imagine
 

In order to enable the functions of a user, we need some information about you, which you provide to us when registering.

We process the following data:

  • First and Last Name

  • E-mail address

 

Later also optional:

  • profile pic

  • Status text

  • Friends

  • Saved posts

  • Push notification token

  • Specified location

 

This data is necessary to communicate with other users on our platform, to interact, to present oneself and to share contributions with other users. The data is processed by Firebase on our behalf and stored on its servers. By registering, the user declares his consent to the processing of the data collected by Firebase in the manner described above and for the purpose stated above. Your IP address will be known to the service during the transfer process. Google does not pass on user data to third parties.

With the iOS app, you are explicitly asked to agree to certain rights such as photo or camera access so that you can decide directly.

Use of push services

The app also uses push services from the operating system manufacturers. These are short messages that are shown on the user's display with the consent of the user and with which he is actively informed about new messages, comments or friendship requests. If the push services are used, a device token from Apple or a registration ID from Google is allocated. The sole purpose of their use by us is to provide push services. These are only encrypted, anonymized device IDs. We cannot draw any conclusions about the individual user.

After registering with Imagine, you can decide whether you want to use this functionality. If you want to unsubscribe from the push messages at a later date, you can use the unsubscribe option in the settings. You can find this in the side menu.

The collection and processing of device-specific information takes place on the basis of Art. 6 Para. 1 S. 1 lit. b GDPR for the purpose of processing contractual relationships with you or Art. 6 Para. 1 lit. f GDPR if and insofar as this is necessary to protect our interests or those of third parties. This can include, in particular, the transfer to Firebase Firestore or Firebase Cloud Functions for the purpose of optimizing the services and increasing usability and user-friendliness. Any data passed on may only be used by third parties for the stated purposes.

 

A collection and processing of personal data may also be considered if:

  • You according to Art. 6 para. 1 sentence 1 lit. a GDPR have given your express consent to this, and

  • in the event that for the transfer according to Art. 6 Para. 1 S. 1 lit. c GDPR there is a legal obligation.

A transfer of personal data to a third country or an international organization is excluded.

 

User contributions and comments

We offer you to publish contributions, questions, answers or opinions in our app, hereinafter referred to as "contributions". If you make use of this offer, we will process and publish your contribution, the date and time of submission and the pseudonym you may have used.

 

The legal basis for this is Art. 6 Para. 1 lit. a) GDPR. You can revoke your consent at any time with effect for the future in accordance with Art. 7 Para. 3 GDPR. All you have to do is inform us of your revocation. Imagine is allowed to use the contributions for advertising purposes. We also process your email address. The e-mail address is processed because we have a legitimate interest in initiating or supporting further steps if your contribution encroaches on the rights of third parties and / or it is otherwise unlawful. The legal basis in this case is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the legal defense that may be necessary.

 

Google Analytics for Firebase

Imagine optionally uses Google Analytics for Firebase. When starting the app for the first time, the user can choose whether to use Google Analytics for Firebase. The user can deactivate the use of Google Analytics for Firebase in the settings of the app at any time.

The information generated about the use of Imagine is transmitted to a Google server with an anonymised IP address and stored there. The IP anonymization function in Analytics sets the last octet for user IP addresses of the type IPv4 and the last 80 bits in the memory for IPv6 addresses to zero. As a result, the exact IP address of the user is not saved.

Google will provide the analyzed information for us in order to evaluate your use of the Imagine app. This usage data forms the basis for statistical, anonymous evaluations, so that trends can be identified, which can be used to improve the offer accordingly. No personal advertising preferences are collected! If the user consents to the use of Google Analytics for Firebase in the Imagine app, he / she declares that he / she agrees to the processing of the data collected about him by Google in the manner described above and for the purpose set out above. The integration takes place on the basis of your express consent in accordance with. Art. 6 para. 1 sentence 1 lit. a and Art. 6 Para. 1 S. 1 lit. f GDPR. It is done to make our app more user-friendly and interesting. This is a legitimate interest within the meaning of the aforementioned regulation.

As a Google company, Firebase is subject to Google's data protection declaration, more information can be found above under "Server data"

 

YouTube

We use YouTube on our website. This is a video portal from YouTube LLC., 901 Cherry Ave., 94066 San Bruno, CA, USA, hereinafter referred to as “YouTube”.

YouTube is a subsidiary of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

Through the certification according to the EU-US data protection shield ("EU-US Privacy Shield") https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active , Google and thus the subsidiary YouTube guarantee that the data protection requirements of the EU are also complied with when processing data in the USA.
